Profile AI — Terms of Service

Please read these Terms carefully — they govern your use of Profile AI.

1. Agreement to these Terms

These Terms of Service (the “Terms”) are a binding agreement between you and Leonard Reuther, the operator of the Profile AI mobile application and related services (“Profile AI”, “we”, “us”). By creating an account, or by downloading, accessing or using the app, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use Profile AI.

Profile AI is distributed through the Apple App Store and Google Play. Apple Inc. and Google LLC are third-party beneficiaries of these Terms and may enforce them against you. Where you obtained the app from the App Store, Apple’s Licensed Application End User License Agreement (LEULA) also applies; where these Terms add to it, these Terms govern as between you and us.

2. Eligibility & age

You must be at least 13 years old (and at least the minimum digital-consent age in your country, which may be up to 16 in the EU) to use Profile AI. If you are under 18, you may use the app only with the involvement and consent of a parent or legal guardian. By using Profile AI you confirm that you meet these requirements.

Profile AI is not directed to children under 13 and we do not knowingly allow them to create an account or upload photos.

3. Your account

You can sign in with Apple, Google, email or your phone number. You are responsible for keeping access to your account secure and for everything that happens under it. Provide accurate information, keep one account per person, and tell us promptly if you believe your account has been compromised.

If you choose a public username and make your profile public, that username and any content you publish become visible to other users (see Section 7).

4. What Profile AI does

Profile AI lets you upload photos of yourself and generate stylized AI portraits and edited images from them, using third-party AI image models (currently OpenAI). All generated images are artificial: they are created or manipulated by AI and are not photographs of real events.

We may change, add or remove features at any time. AI models are probabilistic and we do not guarantee that any particular result, likeness, quality or availability will be produced.

5. The licence you give us for your photos

You keep all rights you already have in the photos you upload. To run the service, you grant us a limited, non-exclusive, worldwide, royalty-free licence to host, store, process, reproduce and modify your uploaded photos solely to operate Profile AI for you — including transmitting them to our AI provider to generate your images, creating thumbnails, and providing safety and support. This licence is limited to operating the service and ends when you delete the content or your account, except for copies we must retain for the limited times described in the Privacy Policy.

We do not use your private uploaded photos to advertise, to train our own models, or for any purpose other than providing the service to you. A separate, broader licence applies only to content you actively choose to make public (Section 7).

6. Consent, likeness & the photos you may upload

This is the most important rule in these Terms. You represent and warrant that, for every photo you upload, you either are the person shown or have that person’s explicit consent, and that you hold all rights and permissions needed to upload it and to create AI images from it.

You must not:

• Upload a photo of another identifiable real person without their consent;
• Upload any photo of a minor;
• Generate images of public figures, celebrities or anyone you cannot lawfully depict;
• Use Profile AI to impersonate, defame, harass or deceive anyone, or to create misleading “deepfake” content of a real person.

If you are depicted in content created or shared by someone else without your consent, contact us at privacy@profile-app.com and we will review and, where appropriate, remove it.

7. Public profiles & shared content

Profile AI includes optional social features: a public username, a public profile, public uploads and people-search. These are off by default. If you turn them on or publish content, you grant us and other users a non-exclusive, worldwide, royalty-free licence to host, display, reproduce and distribute that content within the app so the feature can work.

Anything you make public can be seen, saved and re-shared by others, so do not publish content you would not want to be public. You can make content private again or delete it at any time, which ends this licence going forward.

8. Ownership of the images you generate

As between you and us, we assign to you whatever rights we hold in the images you generate, and you may use them for personal and commercial purposes, subject to these Terms.

Important limitation: images generated by AI may not be protected by copyright in some countries because they lack sufficient human authorship. We therefore make no representation that any generated image is protectable, or that you own an enforceable copyright in it. We also cannot guarantee your output is unique — other users may generate similar images.

9. AI-generated content & transparency

Images you create with Profile AI are AI-generated or AI-manipulated. Where required by law (including Article 50 of the EU AI Act), outputs that realistically depict a person are AI content that may be labelled as such and may carry machine-readable markers.

AI can produce unexpected, inaccurate or unflattering results, and outputs may not look exactly like you. You agree not to present generated images as authentic, unaltered photographs, and not to use them to deceive, impersonate or misrepresent any person.

10. Acceptable use & community rules

When using Profile AI, you agree not to:

• Upload or generate sexual, nude, violent, hateful, harassing or otherwise illegal content, or any sexual content involving minors;
• Break the consent and likeness rules in Section 6;
• Attempt to bypass, disable or probe our safety filters or rate limits;
• Reverse-engineer, scrape, resell or build a competing dataset or model from the service;
• Upload malware or interfere with the security or operation of the app;
• Use the service in any way that violates applicable law or these Terms.

We may use automated and human moderation on uploads and outputs. Violations may lead to content removal, feature limits, suspension or termination of your account, and where required, reporting to the authorities.

11. Moderation, reporting & enforcement

We have the right, but not the obligation, to review, filter, refuse, remove or restrict any content and to suspend or terminate any account, at our discretion, to enforce these Terms or protect users.

You can report content or another user from within the app, or by emailing support@profile-app.com. We aim to review reports of objectionable content and act on them — by removing content and, where appropriate, ejecting the responsible user — within 24 hours.

12. Intellectual property & copyright complaints

Profile AI, its software, design and branding belong to us or our licensors. If you believe content in the app infringes your intellectual property, send a notice to privacy@profile-app.com identifying the content, your rights and your contact details. We operate a notice-and-takedown process and will terminate repeat infringers.

13. Subscriptions & billing

Profile AI offers auto-renewing subscriptions (for example weekly and yearly billing) that unlock Pro access. Provider-backed AI generation is limited to 10 jobs in any rolling 24-hour period for users without Pro access or a completed credit-pack purchase, and 50 jobs for users with either. Free on-device effects use no credits and do not count toward these limits. No more than five provider-backed generations can run at the same time. We may apply lower temporary limits during abuse or exceptional capacity incidents. The price, billing period and what each plan includes are shown on the purchase screen before you buy.

Subscriptions are sold and billed through your app store account (Apple or Google), not directly by us. They renew automatically at the then-current price until you cancel, and your account is charged through the store within 24 hours before each renewal. You can manage or cancel a subscription in your App Store or Google Play account settings; cancellation takes effect at the end of the current paid period.

14. Refunds

Because purchases are processed by Apple and Google, refunds for app-store purchases are handled by them, not by us, and we cannot issue or override store refunds directly. To request a refund for an Apple purchase, visit reportaproblem.apple.com; for Google Play, use Google’s refund process. Statutory withdrawal and consumer rights that apply to you under German/EU law are unaffected by this section.

15. Credits

For users without an active Pro subscription, some actions are paid for with credits. Credits can be bought as one-time, consumable packs. Each standard portrait costs 10 credits; some advanced actions cost more, as shown in the app. Pro access does not periodically add or refresh a credit allowance.

Credits are a limited licence to use a feature of the service. They have no cash value, are not money, are non-transferable and non-exchangeable, and — except where the law requires otherwise — are non-refundable. Credits are consumed only for successful actions. Credits may be forfeited if your account is terminated for breach of these Terms.

16. Disclaimers

To the fullest extent permitted by law, Profile AI is provided “as is” and “as available”, without warranties of any kind, including fitness for a particular purpose, accuracy, likeness fidelity, or uninterrupted availability. Some jurisdictions do not allow certain warranty exclusions, so some of these may not apply to you.

17. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, and our total liability for any claim relating to the service is limited to the amount you paid us in the 12 months before the event giving rise to the claim.

Nothing in these Terms limits liability that cannot be limited by law — including, for consumers in Germany and the EU, liability for intent, gross negligence, injury to life, body or health, or under mandatory consumer-protection or product-liability law.

18. Indemnification

To the extent permitted by law, you agree to indemnify us against claims, losses and costs arising from photos you upload, images you generate or share, your breach of the consent and likeness rules, or your breach of these Terms or applicable law.

19. Suspension & termination

You may stop using Profile AI and delete your account at any time from within the app (Help & Support › Delete Account). We may suspend or terminate your access if you breach these Terms or to protect the service or other users. Sections that by their nature should survive termination (such as ownership, disclaimers, liability and governing law) continue to apply.

20. Governing law & disputes

These Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer-protection rules of the country where you live still apply to you and are not overridden by this choice of law.

The European Commission provides an online dispute-resolution platform at ec.europa.eu/consumers/odr. We are not obliged and generally not willing to participate in dispute-resolution proceedings before a consumer arbitration board.

21. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will give reasonable notice (for example in the app). Continued use after changes take effect means you accept the updated Terms; if you do not agree, stop using the app and delete your account.
